Notice: By downloading, installing, or using the Hikely app, you agree to these Terms & Conditions. Please read them carefully before using the service. If you do not agree, please do not use the app.
1. Acceptance of Terms
These Terms & Conditions ("Terms") constitute a legally binding agreement between you and Hikersandtrails ("we," "us," or "our"), a company incorporated in Turkey, governing your use of the Hikely mobile application and related services (collectively, the "Service").
We may update these Terms from time to time. When we do, we will revise the effective date above and, for material changes, notify you via in-app notices or email. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
2. Description of Service
Hikely is a hiking companion application that provides:
- GPS-based route recording, tracking, and navigation for outdoor activities
- Health and fitness metric monitoring — pace, distance, elevation, and effort scoring
- Apple Watch and Wear OS integration for real-time metrics
- Trail discovery, route planning, and community sharing features
- A personal library ("My Shelf") for saving and managing your hikes
- Pro subscription features including advanced analytics and premium content
We reserve the right to modify, suspend, or discontinue any feature at any time. We will not be liable for any modification, suspension, or discontinuation of the Service.
3. User Accounts
3.1 Registration
To access certain features you must create an account. You agree to provide accurate, current, and complete information during registration and to keep it up to date. You must be at least 13 years of age to create an account.
3.2 Account Security
You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at support@hikersandtrails.com if you suspect any unauthorised use.
3.3 Account Deletion
You may delete your account at any time from within the app settings. Upon deletion, all personal data associated with your account will be removed from our systems in accordance with our Privacy Policy, subject to any legal retention obligations.
4. User Content
4.1 Ownership
You retain ownership of all content you create, upload, or share through the app — including hike recordings, photos, reviews, and route data ("User Content").
4.2 License to Hikersandtrails
By submitting User Content, you grant Hikersandtrails a non-exclusive, worldwide, royalty-free license to store, reproduce, and display that content solely to operate and improve the Service.
4.3 Prohibited Content
You agree not to post content that:
- Is unlawful, defamatory, harassing, abusive, or obscene
- Infringes any third-party intellectual property, privacy, or other rights
- Contains viruses, malware, or harmful code
- Misrepresents trail conditions or safety information in a way that could endanger others
- Is used for commercial solicitation without our prior written consent
We reserve the right to remove any User Content that violates these Terms without prior notice.
5. GPS, Health Data & Safety Disclaimer
⚠ Important Safety Notice
Hikely is a supplementary tool — not a substitute for proper outdoor preparation, professional medical advice, or emergency services. GPS tracking, health metrics, and navigation features are provided for informational purposes only. Never rely solely on Hikely for safety-critical decisions during a hike.
5.1 GPS Accuracy
GPS data depends on your device's hardware, satellite availability, and environmental conditions. Signal loss or device limitations may result in inaccurate position, distance, pace, or elevation readings. GPS data should not be your sole navigation tool in remote areas.
5.2 Health Metrics
Effort scores, heart rate data, calorie estimates, and other health metrics are calculated using algorithms and sensor data from your device or connected wearable. These are estimates only and do not constitute medical advice. Do not use them to diagnose, treat, or manage any health condition.
5.3 Outdoor Activity Risks
Hiking and trail running involve inherent risks including adverse weather, rough terrain, wildlife, and physical exhaustion. You assume full responsibility for assessing trail conditions, your fitness level, and the appropriateness of any route before undertaking it.
5.4 Emergency Services
The app does not provide emergency calling or SOS capabilities. In an emergency, contact local emergency services directly. Always carry a fully charged phone and inform someone of your planned route and expected return time before heading into remote areas.
6. Pro Subscription & Payments
6.1 Subscription Plans
Hikely offers optional Pro subscription plans that unlock premium features. Pricing, billing cycles, and included features are detailed in the app at the time of purchase.
6.2 Billing
Subscriptions are billed in advance on a recurring basis (monthly or annual, as selected). Payment is processed through the App Store (Apple) or Google Play. By subscribing, you authorise recurring charges to your chosen payment method until cancelled.
6.3 Cancellation & Refunds
You may cancel at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused time. For refund requests relating to technical issues, contact support@hikersandtrails.com.
6.4 Free Trial
If a free trial is offered, it converts automatically to a paid subscription at the end of the trial period unless cancelled beforehand.
6.5 Price Changes
We reserve the right to change subscription pricing with reasonable advance notice. Continued use of a Pro subscription after a price change constitutes acceptance of the new pricing.
7. Intellectual Property
All content, code, design, graphics, logos, and features of the app (excluding User Content) are owned by or licensed to Hikersandtrails and are protected by Turkish and international intellectual property laws. You may not copy, modify, distribute, or create derivative works of any app content without our prior written permission.
The Hikely name, logo, and Hikersandtrails brand are trademarks of Hikersandtrails. Nothing in these Terms grants you any right to use our trademarks.
8. Privacy
Your use of the app is governed by our Privacy Policy, incorporated into these Terms by reference. By using the app, you consent to the collection and use of information as described in the Privacy Policy.
9. Third-Party Services
The app integrates with third-party services including Mapbox (maps), Supabase (database and authentication), and Sentry (crash reporting). Your use of those services is subject to their respective terms and privacy policies. Hikersandtrails is not responsible for the content, availability, or practices of any third-party service.
10. Prohibited Uses
You agree not to:
- Reverse-engineer, decompile, or attempt to extract the source code of the app
- Use the app for any unlawful purpose or in violation of applicable laws
- Interfere with or disrupt the app's servers, networks, or infrastructure
- Attempt to gain unauthorised access to any systems or data
- Harvest or scrape data from the app using automated means
- Impersonate any person or entity or misrepresent your affiliation
11. Disclaimers of Warranties
The app is provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by applicable law, Hikersandtrails disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the app will be uninterrupted, error-free, or free of harmful components, nor do we warrant the accuracy or completeness of any GPS data, health metrics, or trail information provided by the app.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Hikersandtrails and its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, personal injury, or property damage arising from your use of the app or participation in outdoor activities.
Our total cumulative liability to you shall not exceed the greater of (a) the amount you paid us in the twelve months prior to the claim, or (b) one hundred euros (€100).
13. Indemnification
You agree to indemnify and hold harmless Hikersandtrails and its officers, directors, and employees from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from: (a) your use of the app; (b) User Content you submit; (c) your violation of these Terms; or (d) your violation of any third-party rights.
14. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the app shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey. If you are a consumer resident of a country that provides mandatory consumer protections, you may also have the right to bring claims before your local courts.
15. Termination
We reserve the right to suspend or terminate your access to the app, with or without notice, if we reasonably believe you have violated these Terms or applicable law. Upon termination, your right to use the app ceases immediately. Provisions that by their nature should survive (including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) shall remain in effect.
16. Changes to These Terms
We may update these Terms at any time. When we do, we will revise the effective date above. For material changes, we will notify you via in-app notification or email. Your continued use of the app after changes are posted constitutes your acceptance of the revised Terms.
